We are aware of the importance of the information and data we collect from, and about, you. Your concern about the confidentiality and security of your information is fully understood and appreciated. We, therefore, take pride in being proactive when it comes to safeguarding your privacy and any information you might provide during your relationship with us. 

This Privacy Policy articulates the terms and conditions by which we collect, process, and store personal and financial information. Our Privacy Policy is based on openness and transparency of how we access, collect and use your information. Our commitment to your privacy has been unwavering since its inception and is wholly aligned with the privacy laws in Kuwait, GCC and the General Data Protection Regulation (GDPR). Beyond their legal obligations, we consider these principles to be good business practice.

By accessing, browsing, and/or using Emcan (including services, website, mobile application, platform, and media), you acknowledge that you have read and understood the Terms and Conditions of this Privacy Policy in its entirety, including any updates that may occur and be posted on our website, mobile application, and/or other media from time to time. Emcan reserves the right to review and update this Privacy Policy, at our discretion. If you do not agree to this Privacy Policy (including any amendments to it as may be made from time to time), please do not use Emcan.

1.0 Definitions

• Emcan FZE LLC: it refers to the business entity including the website (www.joinemcan.com), mobile application, and other media held and run by the business. 
• Pronouns such as “we”, “us”, and “our” refer to Emcan. 
• Pronouns such “you” and “your” refer to the user of Emcan.
• The word “user” refers to the user of Emcan’s Services. 
• Personal Information: information that identifies the user or can be used to identify or contact the user such as name, email address, postal address, or phone number.  
• Terms: it refers to the laws, policies, regulations, and conditions set out in this Policy. 
• Service Provider: any third-party organization that works with Emcan to provide services and/or information. 

2.0 Collected Personal Information

The user has complete control over their money and online identity. The information that Emcan collects from the user or about their use of our Services is dependent on how the user accesses and uses the Services we offer.

We use the information we collect to provide, maintain, and improve our Services throughout the application to offer you the best user experience.

2.1 Visitor Information 

If you are a visitor to Emcan, we do not collect any personal or sensitive information from or about you from the unsecure areas of the Emcan ’s website. If you are a visitor who does not log in to the Emcan ’s Service with a username and password, you therefore remain anonymous. We do not ask for any personal information from visitors.

2.2 User Information 

The user will need to register an account with Emcan, either through our website or our mobile application, to access the secure, password protected features of our Services. When registering an account with Emcan, the user will be asked to provide:

• A phone number and/or an email address to identify the user account.
• Basic personal information (first and last name, date of birth and gender) to configure the Emcan service for your use.
• we may collect other personal information including credit card details (for payment purposes only).
• Emcan may request any additional information according to your settings preference on the application.

We may collect additional data/information from you when you fill out and submit online forms, take actions on the website or mobile application, and/or participate in marketing activities. Such data may include user feedback, purchasing behaviors, and inputs from participating in marketing activities. Any data collected in relation to these activities will be treated in accordance with this Privacy Policy, except as specifically set forth in the rules for those promotions and giveaways.

We store personal data associated with your account for as long as your account remains active. If you decide to remove your account, we will delete your account data within 14 days. We store other personal data for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

We only process personal information for these “legitimate interests” after considering the potential risks to your privacy—for example, by providing clear transparency into our privacy practices, offering you control over your personal information where appropriate, limiting the information we keep, limiting what we do with your information, who we send your information to, how long we keep your information, or the technical measures we use to protect your information.

You have a right of access, rectification, restriction, erasure and data portability. Please contact us if you wish to exercise these rights.

Further, subject to specific requirements, you have the right to object to processing of your personal data based on legitimate interests or a public interest or an official authority vested in us.

Generally, you can review and edit your Personal information in the Account by logging in and updating the information directly. 

3.0 Collected Financial Information

We acknowledge and understand well that Emcan and its Service Providers (e.g. third-party financial institutions) will have a limited access to the user’s bank account/s and credit card/s. The access is limited to Subscription payment process, Thus, Emcan and its Service Providers cannot make any financial action or changes to the user’s account/s and/or credit card/s (e.g. withdraw money, transfer funds, issue cards …etc.) without the user permission. 

The subscription process may vary, ranging from monthly, quarterly, to annually, based on the subscription model selected by Users and the Terms & Conditions of the purchased product.

4.0 Use of Personal Information

4.1 Use of Identity-Revealing Information

We use personal information mainly for providing the services and products needed for a unique user experience. It is also possible that we use personal information from time to time to provide you with information that, as we believe, of interest and value to you. This includes information about our Services, policy changes, updates to our Agreements, developments or changes to the Emcan business, news, announcements, notifications, and/or promotional information. 

We will use your personal information for the purpose disclosed at the time of collection, or otherwise as set out in this Privacy Policy. Except as specifically set out in this Privacy Policy, we will not sell or disclose your personal information to any other person or use your personal information for any other purpose without your prior consent, unless authorized or required by law. 

Generally, we will only use and disclose your personal information for the following purposes:

• to provide you with information you request about us or the products or services we offer through the Emcan Service.
• to provide information to persons expressly authorized by you.
• to manage the Emcan Service (including your Account).
• to arrange for and provide products or services you request from time to time;
• to access or directly link to Third-Party Websites and your Third-Party Accounts;
• to determine and notify you of what products or services (including third party products and services) we consider are likely to be of most interest to you;
• to process and obtain payment for any products or services you apply for through Emcan.
• to understand how you use our Service and to help us improve Emcan, our marketing or the way we do business.
• if necessary, to verify your identity or age (i.e. over 18); and
• to contact you for direct marketing and promotional purposes including providing you with information about new products or services, events and special offers, unless you tell us that you do not wish to receive this type of information.

4.2 Use of Anonymous and Aggregated Data

We may use your data and any personal information, which you have provided to us, to enhance the service we are providing to you. Emcan may use anonymous and aggregated data from our users, and disclose this in a non-personally identifiable manner to third parties, including:

• advertisers and other third parties for their marketing and promotional purposes such as how many users clicked on their advertisement.
• other users of the Emcan Service in order to provide them benchmarks for comparing themselves against the broader Emcan community.
• approved entities/organizations wishing to conduct scientific and/or market research into consumer, financial behaviors, or other important and useful topics; and
• partners who provide their customer with a partner sponsored version of the Emcan Service.

We will keep personal information for the period necessary – reasonably – to achieve the objectives for which personal information has been collected as set out in this Privacy Policy, and in accordance with the prescribed or permissible period under the System.

We will never rent or sell your Personal Information to others. We may share your Personal Information with third parties for the purpose of providing or improving the Service to you. If we do this, such third parties’ use of your Personal Information will be bound by obligations of confidentiality. 

We may store Personal Information in locations outside our direct control (for instance, on servers or databases located or co-located with hosting providers).  Any Personal Information or content that you voluntarily disclose for posting to the Service becomes available to the public, as controlled by any applicable privacy or website customization settings. To change your privacy settings on the Service, you may visit your Emcan account settings page.

5. to protect our commercial rights (operations) or those of any affiliated entities; 
6. to protect the rights, privacy, safety or property of Emcan, its affiliated entities, you, or others; and
7. to permit us to pursue available remedies or limit the damages that we may bear/sustain.

 6.0 External Websites and Platforms 

Our website, mobile application, and/or electronic media may contain links to other websites and/or electronic platforms. These are not under our control and we do not endorse any of them. If you provide any personal information to these websites and/or electronic platforms, such an action will be under your responsibility. We recommend that you carefully read the privacy policy or other agreements by these websites. 

Our Privacy Policy does not extend to cover or apply to external website practices related to data and privacy, including those of allied companies that are not expressly subject to our Privacy Policy.

Our operations are supported by a network of computers, cloud-based servers, and other infrastructure and information technology, including, but not limited to, third-party service providers. 

The parties mentioned above may be established in jurisdictions other than your own and outside the European Economic Area, Switzerland, and the United Kingdom (the “UK”). These countries do not always afford an equivalent level of privacy protection. We have taken specific steps, in accordance with EEA data protection law, to protect your Personal Information. 

7.0 IP address, Cookies, and Aggregate Data

7.1 IP Addresses

It is necessary for Emcan to collect the Internet Protocol (IP) address (i.e., the identifier for your computer when you are using the Internet) of our website users for their interaction with various parts of the Emcan Service. In case Emcan has recorded your IP address, such as when you log in, it is stored for security and audit purposes only. Your IP address will not be used by us or released to any third party except in relation to issues pertaining to security, inappropriate behavior and/or fraud, which may include issues such as unauthorized access to your computer, our systems, or fraudulent transactions.

Please note that we may use your Internet Protocol (IP) address to analyze your activities and improve our website performance.

7.2 Cookies

A “cookie” is a small text file that is stored on your computer, tablet or phone when you visit a website. Emcan uses “cookies” in order to: 

• provide you with the best online experience possible, 
• assist with managing your account.
• identify you on return visits. 
• help Emcan understand more about your preferences in order to deliver a more relevant service. For instance, Emcan may learn from these what kind of offers you like and be able to limit the number of times you see offers not relevant to you. 

If you wish to know when or if you receive cookies from Emcan, you can manually set your browser to notify you of this or, in the case you do not wish to receive cookies, to reject cookies.

We may use Service Providers to help us analyze certain online activities. For example, to help us measure the performance of our online campaigns or analyze visitor activity on Emcan. We may permit our Service Providers to use cookies and other technologies to perform these services for Emcan. It is important to point out that we do not share any personal information about our users with these Service Providers; and our Service Providers do not collect such information on our behalf; and our Service Providers also are required to comply fully with this Privacy Policy.

7.3 Aggregate Data

Although Emcan ’s systems do not collect any personal or sensitive information from or about visitors to Emcan (website and mobile application), they do collect metadata. Examples of metadata include the date and time of each unique visit, any pages viewed, and any content downloaded. Our systems also log the number of times our visitors click on content featured on Emcan. This information is collected only to further develop Emcan and improve the facilities and/or services we are able to offer.

8.0 Information Security 

Emcan takes all reasonable measures to protect your information within our company from loss, misuse, unauthorized access, modification, or destruction. As a matter of fact, no data transmission over the Internet can be guaranteed as entirely secure. We will use all reasonable measures to ensure the security and confidentiality of information and materials in Emcan . 

Once we have received your information, we take reasonable steps to preserve the electronic and physical security of this information in accordance with our Terms of Service and this Privacy Policy. Among other measures to keep information and materials in Emcan  secure and confidential, Emcan :

• regularly reviews and adopts new developments in electronic security and encryption technologies.
• Incorporates top-notch encryptions for financial data/information. 

While we have endeavored to create a secure and reliable website and mobile application for users, we cannot claim that information is 100% secure. If you have reason to believe that your interaction with Emcan is not secure, please notify us immediately through our contact details below.

9.0 User Access to Personal Information

In most cases, the user can access, correct or edit the personal information to share with Emcan via the user’s Emcan account. The user may request access to any personal information which Emcan holds about him/her at any time by contacting us (see the details below). 

Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). We may charge you a fee to cover our administrative and other reasonable costs in providing the information to you. Please note that we will not charge for simply making the request and will not charge for making any corrections to your personal information.

There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal.

If you believe that the personal information, we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it.

10.0 Control Over Communications and Information 

When you register to use Emcan, you can configure whether you want us to send direct communications to you. These include communications related to transactional activity on your financial accounts or direct marketing communications. 

You can opt out or configure how you receive communications on transactional activity by accessing the “Alert Settings” within your Account Settings. You can opt out of direct marketing communications by selecting Unsubscribe from any marketing emails that you receive. There are, however, certain forms of essential correspondence that users of Emcan cannot opt out of receiving, which include:

• correspondence pertaining to confirmation of your registration with Emcan. 
• notifications of changes to our Terms of Service and/or this Privacy Policy; or
• anything else we are required or authorized to send you in accordance with the laws in Kuwait.

Emcan takes all reasonable measures and steps to allow you control over sending and receiving information. You may cancel your Account at any time by accessing the delete account option available through our website. Emcan reserves the right to use any aggregated and anonymous data derived from your utilization of the Service up to this point.

11.0 Complaint Submission and Process

Emcan is committed to deal with all complaints quickly, efficiently, fairly and in a timely manner, and we take all our users’ and visitors’ feedback seriously. We will be happy to address and/or assist you with any feedback or concern you may have and encourage you to file a complaint with us whenever necessary. 

If you believe that your privacy has been breached, please contact us using any of the communication methods below. To help us address your complaint quickly, please provide:

• any relevant document or information; and 
• a detailed explanation of problem.

• المستخدم يشار اليه ايضا ب ” انت ” ويقصد بالمستخدم مستخدم خدمات إمكان.

• المعلومات الشخصية هي المعلومات التي تعرف هوية المستخدم أو تستخدم في تحديد المستخدم او الاتصال به مثل الاسم ، عنوان البريد الإلكتروني ، العنوان البريدي ، أو رقم الهاتف.

• الشروط تشير إلى وتتضمن القوانين والسياسات واللوائح والشروط المنصوص عليها في هذه الاتفاقية.

• مزود الخدمة أي مؤسسة خارجية تعمل مع إمكان لتوفير العناصر الأساسية لخدمات إمكان.

يتمتع المستخدم بالتحكم الكامل في أمواله وهويته عبر الإنترنت. البيانات والمعلومات التي تجمعها إمكان من أو عن المستخدم تعتمد على طريقة استخدام واستعمال المستخدم للخدمات التي تقدمها إمكان.

نستخدم المعلومات التي نجمعها لتوفير خدماتنا وصيانتها وتحسينها في التطبيق لنقدم لك أفضل تجربة مستخدم  ممكنة.

•  معلومات الزائر

في حالة زيارة إمكان للاطلاع فقط، فإننا لا نجمع أي معلومات شخصية أو حساسة منك أو عنك من المناطق غير المؤمنة في موقع إمكان الالكتروني أو التطبيق، وإذا كنت زائرا لا تمتلك اسم المستخدم وكلمة مرور لتسجيل دخول إلى خدمات إمكان، فإنك تظل مجهول الهوية بالنسبة لنا، ولا نطلب أي معلومات شخصية من الزوار.

• معلومات المستخدم

يتطلب من المستخدم تسجيل حساب لدى إمكان، إما عن طريق الموقع الالكتروني او التطبيق، لكي تصل الي خدماتنا المحمية والمؤمنة. 

عند تسجيلك لحساب لدينا سوف يتم طلب منك الاتي:

• رقم هاتف و/او عنوان بريد الكتروني لإنشاء وتحديد حساب المستخدم.
• بيانات اساسية (الاسم الاول واسم العائلة، تاريخ الميلاد، الجنس) لتهيئة خدمات إمكان من اجلك.
• معلومات شخصية عن الوضع الصحي وتفاصيله.
• قد تقوم إمكان بطلب اي بيانات اخري طبقا لاختيارك للخدمات في التطبيق.

قد نجمع بيانات او معلومات إضافية منك عند تعبئة النماذج وإرسالها عبر الإنترنت، أواتخاذ إجراءات على الموقع الإلكتروني أو تطبيق الهاتف المحمول، و/أو المشاركة في الأنشطة التسويقية. قد تتضمن هذه البيانات ملاحظات المستخدم والسلوكيات الشرائية والمدخلات من المشاركة في الأنشطة التسويقية. سيتم التعامل مع أي بيانات يتم جمعها فيما يتعلق بهذه الأنشطة وفقًا لسياسة الخصوصية هذه، باستثناء ما هو منصوص عليه ومحدد في شروط تلك العروض الترويجية والهدايا.

بشكل عام، لن يتم استخدام او الكشف عن معلوماتكم الشخصية الا في الاغراض التالية: 

• لتزويد المستخدم بالمعلومات التي يطلبها عنا أو عن المنتجات أو الخدمات التي نقدمها عن طريق إمكان.
• تقديم المعلومات إلى الأشخاص مصرح لهم من المستخدم.
• لإدارة خدمات إمكان (بما في ذلك حسابك).
• لتجهيز وتقديم المنتجات أو الخدمات التي يطلبها المستخدم من وقت لآخر.
• للوصول مباشرة إلى مواقع أطراف اخري وحساباتك الأخرى.
• لتحديد المنتجات أو الخدمات (بما في ذلك منتجات وخدمات الأطراف الاخري) التي من المرجح أن تكون ضمن اهتماماتكم وإبلاغكم بها.
• لمعالجة والحصول على المدفوعات مقابل اي من المنتجات او الخدمات المطلوب الحصول عليها منا.
• لفهم كيفية استخدامك لخدماتنا ومساعدتنا على تحسين إمكان أو تحسين الأنشطة التسويقية في إمكان أو تحسين أسلوب عملنا.
• لتحقق من هوية أو سن المستخدم (أي أكثر من 18 عاما) إذا لزم الأمر.
• للتواصل مع المستخدم لأغراض التسويق المباشر والترويج ، بما في ذلك تزويدك بمعلومات عن المنتجات أو الخدمات الجديدة، والأحداث والعروض الخاصة، ما لم تخبرنا أنك لا ترغب في تلقي هذا النوع من المعلومات.

• استخدام البيانات المجمعة والغير معرفة للهوية

قد نستخدم أي من البيانات والمعلومات الشخصية التي تقدم لنا، لتحسين الخدمة التي نقدمها لكم. وقد تستخدم إمكان بيانات مجهولة المصدر ومجمعة من مستخدمينا، ليتم الكشف عنها للغير بطريقة غير شخصية وغير قابلة لتحديد أو التعرف على هوية المستخدم، بما في ذلك:

• المعلنون وغيرهم من الاطراف الأخرى وذلك لأغراض تسويقية وترويجية خاصة بهم، مثل عدد المستخدمين المهتمين بإعلاناتهم
• المستخدمون الاخرون لخدمات إمكان من اجل تزويدهم بنقاط مرجعية لمقارنة ادائهم بمجتمع إمكان الواسع.
• الجهات المعتمدة التي ترغب في اجراء بحوث علمية او/وتسويقية في السلوك المالي او الاستهلاكي أو غيرها من المواضيع المهمة والمفيدة.
• الشركاء الذين يقدموا لعملائهم خدمات إمكان باستخدام نسخة شريك من تطبيق إمكان.

سنقوم بالاحتفاظ بالبيانات والمعلومات الشخصية للفترة اللازمة – على نحو معقول – لتحقيق الأهداف التي جمعت من أجلها المعلومات الشخصية على النحو المبين في هذه الاتفاقية، ووفقا للفترة المحددة أو المسموح بها بموجب القانون.

لن نقوم أبدًا بتأجير أو بيع معلوماتك الشخصية للغير.

قد نشارك معلوماتك الشخصية مع أطراف ثالثة لغرض توفير أو تحسين الخدمة لك. إذا قمنا بذلك ، فسيكون استخدام الغير لمعلوماتك الشخصية ملزمًا بالتزامات السرية.

قد نقوم بتخزين المعلومات الشخصية في مواقع خارجة عن سيطرتنا المباشرة (على سبيل المثال ، على الخوادم أو قواعد البيانات الموجودة أو المشتركة مع مقدمي الاستضافة).

مع عدم الاخلال بمسؤوليتنا الأساسية في الحفاظ علي سرية وامان جميع البيانات الشخصية، يجوز لنا الكشف عن البيانات الشخصية في الحالات الاتية:

1. الوفاء بما تتطلبه الأنظمة أو اللوائح أو القواعد ذات العلاقة بنشاط إمكان في دولة الكويت ودول مجلس التعاون الخليجي،
2. للوفاء بمتطلبات الاجراءات القانونية،
3. للرد على طلبات الجهات الحكومية والسلطات العامة،
4. لتنفيذ أحكام وشروط استخدام إمكان، 
5. لحماية عملياتنا التجارية أو عمليات الشركات الحليفة،
6. لحماية حقوق إمكان وحقوق حلفائها وحقوق الغير وحقوقك، وخصوصيتهم، وسلامتهم وممتلكاتهم، 
7. لتمكيننا من المطالبة بأية تعويضات أو إجراءات قانونية متاحة لنا أو لتقليص الأضرار التي قد نتكبدها.

•  المواقع والمنصات الالكترونية الخارجية 

قد يحتوي موقعنا الالكتروني او التطبيق على روابط لمواقع أخرى. هذه الروابط ليست تحت سيطرنا الكاملة كما أننا لا نزكي أياً منهم. إذا قمت بتزويد اي من هذه المواقع بأي بيانات أو معلومات شخصية فإن ذلك سيكون تحت مسئوليتك الكاملة وأننا نوصي بانه عليك قراءة وفحص سياسة الخصوصية الخاصة بتلك المواقع. وللتأكيد فإن سياسة الخصوصية هذه لا تمتد إلى أو تنطبق على ممارسات المواقع الخارجية المتعلقة بالبيانات والخصوصية بما في ذلك المواقع الخاصة بالشركات الحليفة التي لايتم إخضاعها بشكل صريح لأحكام سياسة الخصوصية هذه.

من الضروري بالنسبة لنا الحصول على عنوان بروتوكول الإنترنت (وسيلة لتعريف حاسوبك عندما تستخدم الإنترنت) من مستخدمي وزوار إمكان من خلال تفاعلهم مع إمكان . في حالة تسجيلنا لعنوان بروتوكول الانترنت الخاص بك – مثل عند تسجل الدخول – فإنه يتم تخزينه لأغراض الأمن والمراجعة فقط. ولن نستخدم عنوان بروتوكول الإنترنت الخاص بك أو نفصح عنه لأي طرف ثالث إلا فيما يتعلق بالمسائل المتعلقة بالأمن، أو السلوك غير اللائق و/أو الاحتيال، التي قد تشمل مسائل مثل الوصول غير المصرح به إلى حاسوبك، أو أنظمتنا، أو المعاملات الاحتيالية. 

يرجى ملاحظة أننا قد نستخدم عنوان بروتوكول الإنترنت لتحليل نشاط المستخدم وتحسين أداء إمكان على الإنترنت.

• ملفات تعريف الارتباط 

ملف تعريف الارتباط هو ملف نصي صغير يتم تخزينه على الحاسب الآلي الخاص بالمستخدم أو الزائر، أو الجهاز اللوحي، أو الهاتف الذكي عند زيارة موقع إلكتروني ما. 

تستخدم إمكان ملفات تعريف الارتباط من أجل:

• تزويد المستخدم بأفضل تجربة ممكنة على الإنترنت
• المساعدة في إدارة حساب المستخدم في إمكان  
• التعرف عليك عند زيارتنا مجددا
• مساعدتنا على فهم المزيد حول تفضيلاتك من أجل تقديم خدمة أكثر صلة باحتياجاتك. على سبيل المثال، قد يتعلم (إمكان) ما العروض التي تعجبك، ويكون قادراً على تحديد وتقليص عدد المرات التي ترى فيها العروض الغير مهمة لك.

إذا كنت ترغب في معرفة متي او إذا كنت تتلقي ملفات تعريف الارتباط من إمكان، يمكنك يدويا تحديد المتصفح لاخبارك بذلك او لرفض تلك الملفات او في حالة عدم رغبتك في استقبالها.

يمكننا الاستعانة بمزودي الخدمات لمساعدتنا في تحليل بعض الأنشطة على الإنترنت. على سبيل المثال، لمساعدتنا على قياس او تقييم أداء حملاتنا الدعائية على الإنترنت أو تحليل نشاط الزوار في إمكان. قد نسمح لمزودي الخدمات التابعين لنا في استخدام ملفات تعريف الارتباط والتقنيات الأخرى لأداء هذه الخدمات لإمكان. ومن المهم الاشارة الي ما يلي:

• نحن لا نشارك أي معلومات او بيانات شخصية عن مستخدمينا مع مزودي الخدمات هؤلاء. 
• لا يقوم مزودي الخدمات بجمع هذه المعلومات او البيانات نيابة عنا. 
• مزودي الخدمات التابعين لنا مطالبون ايضا بالامتثال الكامل لسياسة الخصوصية.

• البيانات المجمعة

علي الرغم من عدم جمع انظمة إمكان لاي بيانات شخصية او حساسة من او عن زوار إمكان، فأنها تجمع البيانات الوصفية. تشمل أمثلة البيانات الوصفية تاريخ ووقت كل زيارة، وأي صفحات مشاهدة، وأي محتوى يتم تنزيله. أنظمتنا أيضا تقوم بتسجيل عدد مرات النقر على المحتوى المعروض في إمكان. ولا تجمع هذه المعلومات إلا لمواصلة تطوير إمكان وتحسين المرافق و/أو الخدمات التي يمكننا تقديمها.

•  أمن البيانات والمعلومات

تتخذ إمكان جميع التدابير اللازمة لحماية معلومات المستخدم من الخسارة أو سوء الاستخدام أو الوصول غير المصرح به أو التعديل أو الهلاك. وفي حقيقة الأمر، لا يمكن ضمان أي نقل للبيانات عبر الإنترنت على أنه آمن تماما، وسنستخدم جميع التدابير اللازمة لضمان أمن وسرية المعلومات والمواد في إمكان.

بمجرد تلقينا معلوماتكم او بياناتكم، سنقوم باتخاذ الخطوات اللازمة للحفاظ على الأمن الإلكتروني والمادي لهذه المعلومات وفقا لشروط خدمتنا وسياسة الخصوصية هذه. ومن بين التدابير الأخرى التي تهدف إلى الحفاظ على أمن وسرية المعلومات والمواد في إمكان فنحن:

• نراجع ونتبنى بانتظام التطورات الجديدة في تقنيات الأمن الإلكتروني والتشفير وحماية البيانات. 

• نستخدم انظمة تشفير متميزة لحماية البيانات والمعلومات المالية.

رغم حرصنا الدائم على توفير موقع الكتروني وتطبيقات آمنة وموثوقة للمستخدمين، إلا أننا لا ندعي أن الموقع والتطبيقات ستكون آمنة تماماً، فإذا كان لديك سبب للاعتقاد بأن استخدامك للموقع لن يكون آمنا، فإننا نرجو إخطارنا بالمشكلة فوراً من خلال معلومات الاتصال الموضحة أدناه.

• وصول المستخدم للمعلومات الشخصية

في معظم الحالات، يمكن للمستخدم الوصول إلى المعلومات الشخصية التي يشاركها مع إمكان أو تصحيحها أو تحريرها عن طريق حسابه الشخصي في إمكان. قد يطلب المستخدم الوصول إلى أي معلومات شخصية نحتفظ بها عنه في أي وقت من خلال الاتصال بنا (انظر التفاصيل أدناه).

حيثما نحتفظ بالمعلومات التي يحق لك الوصول إليها، سنحاول تزويدك بوسائل مناسبة للوصول إليها (على سبيل المثال، عن طريق إرسالها عن طريق البريد أو إرسالها بالبريد الإلكتروني)، قد نقوم بفرض عليك رسومًا لتغطية تكاليفنا الإدارية وغيرها من التكاليف اللازمة   لتوفير المعلومات لك. يرجى ملاحظة أننا لن نفرض رسومًا على تقديم الطلب ولن نفرض رسومًا على إجراء أي تعديلات او تحديثات على بياناتك الشخصية.

قد تكون هناك حالات لا يمكننا فيها منحك حق الوصول إلى البيانات الشخصية التي نحتفظ بها. على سبيل المثال، قد نحتاج إلى رفض الوصول إذا كان منح الوصول يتعارض مع خصوصية الآخرين أو إذا كان ذلك سيؤدي إلى انتهاك السرية، في حالة حدوث ذلك سنقوم بذكر اسباب الرفض.

إذا كنت تعتقد أن المعلومات الشخصية التي نحتفظ بها عنك غير صحيحة أو غير كاملة أو غير دقيقة، فيمكنك أن تطلب منا تعديلها. سننظر فيما إذا كانت المعلومات تتطلب التعديل. إذا لم نوافق على وجود أسباب لهذا التعديل، فإننا سنضيف مذكرة إلى المعلومات الشخصية الخاصة بك للإشارة إلى عدم موافقتكم عليها.

10.0 التحكم في الاتصالات والبيانات

عند تسجيلك لاستخدام إمكان، يمكنك ضبط الإعدادات حول ما إذا كنت ترغب في أن يتم التواصل معك أم لا. بعض المراسلات تخص نشاط المعاملات على حساباتك المالية او مراسلات تسويقية مباشرة.

يمكنك إلغاء الاشتراك أو تعديل كيفية تلقي المراسلات بشأن نشاط حساب إمكان من خلال الوصول إلى “إعدادات التنبيه” ضمن إعدادات حسابك. يمكنك إلغاء الاشتراك في المراسلات التسويقية المباشرة عن طريق تحديد إلغاء الاشتراك من أي رسائل بريد إلكتروني تسويقية تتلقاها. ومع ذلك، هناك أنواع معينة من المراسلات الأساسية التي لا يمكن لمستخدمي إمكان رفض تلقيها، والتي تشمل:

• المراسلات المتعلقة بتأكيد تسجيل الحساب
• إخطارات بالتغييرات على شروط الخدمة و / أو سياسة الخصوصية؛ أو
• أي شيء آخر مطلوب منا أو مفوضين لإرساله إليك وفقًا للقوانين في دولة الكويت.

تتخذ إمكان كافة الاجراءات والخطوات المتطلبة للسماح لك بالتحكم في ارسال واستقبال المعلومات. يمكنك الغاء حسابك في أي وقت عن طريق الوصول الي خيار حذف الحساب عن طريق الموقع الالكتروني او تطبيق المحمول. 

تحتفظ إمكان بالحق في استخدام اي بيانات مجمعة او مجهولة المصدر الناتجة عن استخدامك للخدمة.

11.0 تقديم الشكاوى 

تلتزم إمكان بالتعامل الفوري مع جميع الشكاوى بسرعة وكفاءة عالية، ونأخذ تعليقات المستخدمين والزوار على محمل الجد. سنكون سعداء بمساعدتك في أي ملاحظات أو مخاوف قد تكون لديك ونشجعك على تقديم شكوى إلينا كلما اقتضي الأمر.

إذا كنت تعتقد أنه تم انتهاك خصوصيتك، فيرجى الاتصال بنا باستخدام أي من طرق الاتصال أدناه. لمساعدتنا في معالجة الشكوى في أسرع وقت ممكن، يرجى تزويدنا بالتالي:

• الاسم (كما هو مسجل في إمكان)
•  بيانات التواصل
• أي معلومات أو مستندات ذات صلة بالشكوى
• شرح مفصل للمشكلة

سنقوم بمراجعة الشكوى التعامل معها ومن ثم نزودك برد شفهي أو كتابي من خلال وسيلة اتصال مقبولة (مثل البريد الإلكتروني) في أقرب وقت ممكن. عادة يكون الرد في غضون 10 أيام عمل ولكن في أسوأ الظروف فإن مدة الرد لن تتجاوز45 يومًا من تاريخ استلام الشكوى.
